SHOOTING TIME / ADDITIONS:
The client and the photographer agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time. If the client does not arrive at the appointed time for the wedding, shooting will commence at the scheduled start time and end at the scheduled end time. All additional time beyond the scheduled end time will be billed to the client. If the photographer does not arrive at the appointed start time for the wedding, shooting will commence at the time the photographer arrives and time lost due to the photographer’s lateness will be time added to the appointed end time for the wedding.
EXPENSES INCURRED:
When applicable, the client is responsible for all travel, accommodation and transport costs for weddings held outside of the Dunedin city area.
TRAVEL EXPENSES
Accommodation charges of $180 per night, flight costs and rental vehicle expenses will be added if necessary. 75 cents per kilometre will be charged to the client when travel is needed outside of the Dunedin city area. Travel expenses may be subject to change depending on the location of the wedding and whether one or two photographers are required.
RESPONSIBILITIES:
The photographer is not responsible for compromised coverage due to causes beyond the control of the photographer including but not limited to obtrusive guests, lateness of the client or guests, weather conditions, schedule complications, incorrect addresses provided to the photographer, rendering of decorations, or restrictions of the locations. The photographer is not responsible for backgrounds or lighting conditions, which may negatively impact or restrict the photo coverage. The photographer is not held liable for missed coverage of any part of the wedding. The photographer will not be held accountable for failure to deliver images of any individuals or any objects at the wedding.
FILM AND COPYRIGHTS:
The photographs produced by the photographer are protected by federal copyright law (all rights reserved) and may not be reproduced in any manner without the photographer’s explicitly written permission. The photographer shall own the copyright on all images created during the event and shall have exclusive right to make unrestricted reproductions for whatever purpose. The photographer grants the client permission to share the images on social networking websites, with family and friends, and on vendor websites as long as the images remain unaltered and textual credit is explicitly given to the photographer. The client must obtain written permission from the photographer prior to publishing or selling the photographs.
LIMIT OF LIABILITY:
Deliverable items are contingent upon the client performing certain actions and cooperating. The photographer is not liable if the client’s neglect leads to a compromise of what the photographer promised. For instance, if the photographer agrees to take photos of the bride getting ready for her big day, but she doesn’t make herself available at this time, the photographer was denied the opportunity to hold up the photographer’s end of the agreement and isn’t liable for that exclusion.
In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the photographer’s control, including but not limited to camera, hard drive, or equipment malfunction, the photographer liability is limited to the return of all payments received for the wedding. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. The photographer is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package or one year.
CAPTURE AND DELIVERY:
The photographer is not liable to deliver every image taken at the event. The determination of images delivered to the client is left to the discretion of the photographer. Images will be delivered within a 12 week period, however, your photographer will strive to deliver your images within the 8 weeks following your wedding date. If your wedding falls a month or two before Christmas or new year for example, expect to receive your images within 12 weeks.
POST PRODUCTION AND EDITING:
The final post-production and editing styles, effects, and overall look of the images are left to the discretion of the photographer.
TERMS OF PAYMENT:
A non-refundable $650 deposit is required to secure your date. Total payment must be paid in full 3 days prior to the day of the wedding unless other payment arrangements have been made with the photographer personally and there is written evidence that the photographer and the client have mutually agreed upon other payment arrangements. If the client fails to meet these requirements the photographer is not liable to show up to the event until the photographer has received proof of payment. The photographer will not begin post- production and editing until they have received full payment from the client. If 30 days pass after the date of the wedding and the photographer has still not received payment, the photographer does not hold any responsibility to continue communicating with the client or take any action towards working on the client’s wedding photos.
DELIVERY DATE & TIME PERIOD:
Digital photos and professional prints will be sent away for delivery approximately 8 weeks after the date of the wedding. An exact timeframe is impossible to predict as it depends strongly on how busy the photographer is in the months during and/or either side of the wedding. If there are delays, you will still receive your photo package within 12 weeks of your wedding date.
A successful delivery is dependent upon the client and the photographer supplying their own correct details to one another and the method used to deliver the goods. If possible/realistic for both parties, the photographer will deliver the goods to the client personally.
The photographer and the client must both agree on the delivery method before the package is sent. If the photographer and the client cannot come to an agreement, the client must pick up the package.
If the photographer has supplied incorrect contact details or does not go out of their way to correct this once realised they have made a mistake: The client is not reliable for any payment for any item, which is noted in the contract, which should have been delivered or paid by a certain date.
O the client has every right to book another photographer should the photographer stated in this contract fail to reply to important enquiries and questions after 14 days from the first time of contact unless good reason is given during those 14 days.
The photographer is not liable for the goods once sent away to be delivered given the photographer has:
O printed the correct delivery address, which the client has stated in this contract and signed.
O used a trusted delivery method, which was mutually agreed on between the photographer and the client, and has paid a fee to have the package tracked if applicable.
POLICIES ON OTHER PHOTOGRAPHERS:
It is ok for your guests to have cameras and to be taking photos during most of your wedding, but there are a few things to keep in mind to ensure that the photographer you hired can do the best job possible.
It is very important when the photographer is setting up a photo that your guests don’t get in the way and try to push in front of your photographer to take advantage of the photo opportunity being set up. The use of professional cameras with interchangeable lenses during certain photo sessions is not allowed. If truly necessary, the photographer will make judgments and decisions on the day to talk to anyone who might jeopardise the photographer’s work. They may also politely ask for people to turn off their camera flashes if the photographer feels this is impacting negatively on their work. I prefer that you ask your guests to please put away their phones and cameras during the ceremony. This is not compulsory but it does contribute toward me doing the best job that i can and means less phones and cameras in front of your guests faces as i photograph them.
CANCELLATION & POSTPONEMENT:
In the unlikely event that the assigned photographer is unable to perform to the guidelines of this contract due to an injury, illness, act of god, act of terrorism, or other cause beyond the control of the photographer, the photographer will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the wedding and the photographer then claims no further liability beyond that.
In the unlikely event the client has to cancel the wedding due to an injury, illness, act of god, act of terrorism, or other cause beyond the control of the client the photographer must return all payments to the client that the client has made to the photographer for this wedding. If the client has to postpone the wedding for any reason, the photographer must supply their services for the new wedding date given the photographer is available on the new date. If the photographer is not available and the client has informed the photographer of the change 60 days prior to the original wedding date, there will be no cancellation fee. If the client postpones the wedding 60 days or less before the agreed wedding date and the photographer is unavailable on the new wedding date, the photographer will retain the deposit payment that was paid to the photographer by the client at the time this wedding was confirmed.
ALBUMS
Photo albums can take up to 6 months before they are delivered to the client. This is dependent on when the photographer is able to finish editing the client’s photos and when the album supplier can complete and send the albums away for delivery.
The layout and design of an album included in a package or purchased from the photographer by the client will be left to the discretion of the photographer. However, the photographer will run a draft copy by the client before it is sent away for printing.
The client will have a selection of cover options, which the photographer will discuss with the client upon sending a draft copy.
Once the client has access to their online gallery, the photographer will ask the client to choose a selection of their favourite images which they would like in their album. The remaining images will be selected by the photographer. The photographer will simply piece together your images into a template that best describes your day and helps to tell a story. If the client is unhappy with the photographer’s selection of images the client may replace the images with others of their preferred choice.
The album will be shipped to the photographers address. The photographer will inform the client of the arrival of their album as soon as it has arrived. The photographer will discuss a pick up time and location with the client. If the client cannot pick up the album, the album will be couriered to the client.
Delivery: approximately 20 working days. This can change from time to time. The photographer will be able to see when the package has been shipped and should be able to give an estimation on delivery at this point.

If the photographer has not heard from the client within 6 months from the date of first point of contact regarding their album, the photographer will assume the client no longer wants an album and can retain any deposit or payment made to the photographer by the client for the album. The photographer will store your images for 12 months from the date of your wedding. After which the photographer may dispose of your images in order to free up space for the coming wedding season. It is recommended that you keep several copies of your images to avoid this happening. The photographer is not liable for any damage to an album, which might occur during the shipping and handling process. That said, if the damage occurred during the distributors shipment process before it reached the photographer’s door, it is the photographer’s responsibility to look into this for the client and attempt to have the album replaced by the album distributor at the distributors cost. If this process is unsuccessful the photographer is not liable for any replacements due to loss or damage. The photographer uses a professional, confident, quality product to discourage this from happening.
The photographer would prefer the client picks up their album to avoid any damage happening during the shipment process within New Zealand. If the album needs to be posted within NZ or further abroad, the photographer will take precautions in insuring the package gets to your door safely.
